A Langdon & Emison legal team led by Partner Brett Emison was able to obtain a significant settlement in a trucking accident case that recently closed.  The successful representation was another favorable outcome for the firm in recent months related to trucking accidents.

In this accident that took place on a rural Midwestern highway, a semi-truck collided with a vehicle driven by the firm’s client, a 77-year old woman who was hospitalized due to her injuries sustained in the wreck.  She had slowed the car in anticipation of the semi-truck, but was side-swiped anyway, which caused her car to leave the roadway. 

The legal team was able in this instance to illustrate how the truck driver was not keeping a careful lookout, was following too closely, and/or was driving too fast for conditions.  The force of the impact left the firm’s client with a severely crushed heel, severe bruising in her chest and associated cardiac and respiratory problems.  

Due to the client’s injuries and the resulting reactive, moderately severe depression, the firm argued that it was unlikely that she would be able to live alone in the future.  This would require 24-hour home health care, funding for which was recovered in the successful lawsuit.

Langdon & Emison has successfully obtained eight-figure verdicts and settlements for truck accident victims and their families, including clients injured in collisions.  In these cases, the legal team has evinced liability due to defects in the truck involved in the crash, unqualified or fatigued truck drivers, faulty equipment and maintenance, or overloaded trailers.
