Brennan Delaney, Summer Davidson Published by Colorado Trial Lawyers

The Colorado Trial Lawyers Association has published L&E attorneys Brennan Delaney and Summer Davidson with “How and Why You Should Explore Potential Product Defect Claims in Your UTV Crash Case.”

The article appears in the third quarter issue of Trial Talk magazine, which goes out to all members of the CTLA.  The CTLA is the premier organization for plaintiffs’ attorneys in the state of Colorado.  Brennan and Summer have spoken and published before on this topic of UTV’s, in fact this article itself first appeared in the August 2026 Journal of the Kansas Trial Lawyers Association.

Not surprisingly, given the rudimen tary testing for the ROHVA voluntary standards, UTVs have had and con tinue to have numerous dangerous defects that injure and kill their occupants. Exacerbating this problem has been the industry’s failure to address problems when they arise.

 

For example, in 2012, Ken d’Entremont, a Polaris safety director, stepped down from his job after Polaris refused to recall its RZR models due to fire issues. According to d’Entremont, while it was his “heart felt feeling and belief that the vehicle should be recalled,” Polaris was “hesi tant to put the brakes on” the RZR be cause it “was a big moneymaker.” As a result, “it was no longer possible for [d’Entremont] to continue working there ethically.” When asked about this in his deposition, d’Entremont ex plained the ethical metric he uses and, in fact, the one he now teaches his engineering students as a professor, is “Would you let your family, your loved ones use this vehicle?” So, when d’Entremont reached the point where he would not let his family and loved ones use a Polaris RZR, it was time for him to leave that company.

Summer and Brennan both work in the firm’s Independence, Mo., office, on catastrophic injury cases.  They have been lead counsel for clients all over the country, related to premises liability, defective vehicles, dram shop, and other personal injury matters.
